A security deposit (refundable) of $500 is required 48hours prior to booking date. This payment is separate to your booking total.

If you wish to take our boats off road, please call 0415738027 to discuss your trip prior. A security deposit of $750 (refundable) may be required due to the higher risk of damage to hired goods.


LAUNCH AND RETRIEVE

Please note: Boats are to be returned cleaned and refuelled with a full tank of unleaded fuel, speak to us about the options we have available. If no option specified a $40 cleaning fee as well as cost to refuel boat will be deducted from your security deposit.


Boats are to be returned cleaned with a full tank of Unleaded fuel.



VESSEL CONDITIONS AND TERMS OF USE AGREEMENT

1. VESSEL/TRAILER/EQUIPMENT OPERATIONS

a)  The Hirer must hold a current drivers licence in order to collect and transport the vessel that is carried by a trailer.

b)  The Hirer declares and warrants that they possess the necessary ability and skills to transport and manoeuvre a vessel on atrailer.

c)  ONLY the person nominated as the Hirer and complying with 1 (a), and (b), is to drive the vessel.

d)  Hirer must not exceed 2 nautical miles from the NT coastline.

e)  Vessel can ONLY be operated during daylight hours.

f)  Maximum number of persons on vessel must not exceed the number that the vessel is licensed to carry.

g) The Hirer may not be under the influence of alcohol or drugs while driving the vessel.

h) NO smoking on the vessel at any time.

i)  Vessel and equipment are to be returned in the same condition as at the time of hire.

j)  Vessel is to be returned with a full tank of fuel.

k) Vessel and equipment are to be returned thoroughly cleaned, free of bait and rubbish.

l)  The Hirer and passengers must remain out of the water at all times as crocodiles inhabit the waters in the NT.

m)  Reasonable care of the vessel must be taken by the Hirer at all times and, if as a result of the negligence, wilful act or omission of the Hirer the vessel fails to be returned as agreed, then the Hirer is liable to pay any damages or recovery cost associated with the return of the vessel.

n)  In the event that the vessel has not been returned within the agreed set times, and the Hirer has not notified BBH at least ONE HOUR after agreed return time, BBH’s emergency procedure will be initiated. A copy of the BBH emergency procedure to the Hirer is available onboard the vessel.

o)  Any and all associated costs incurred during the emergency procedure is the responsibility of the Hirer.

p)  Late return of vessel will incur a fee of $500 per day for each day the vessel is not returned.

q)  Early return of vessel will not entitle the Hirer to a discount on agreed amount.

r)  The Hirer is to refer to and comply with the BBH Boat Operations Manual for operational information, a copy will be available onboard the vessel.

s)  The Hirer is to refer to and comply with the Northern Territory Safety Guide for pleasure craft, Edition 9, a copy of which will be emailed by BBH to the Hirer. A copy will also be available onboard the vessel.

t)  Any traffic infringements, traffic fines or breach of road traffic laws or maritime laws that are incurred are the responsibility of the Hirer. 

u)  The Hirer agrees that any traffic infringements, traffic fines or breach of road traffic laws or maritime laws that incur a loss of demerit points, monetary penalty or any other penalty made by law, will be transferred to the Hirer, and the Hirer accepts full responsibility.


2. DEPOSIT

a)  Five hundred dollars ($500) security deposit is required 48hours prior to booking date. A signed copy of this agreement will be requested at time of collection.

b)  Deposit is refundable on return of vessel, provided vessel and equipment are returned within agreed times, undamaged, with no loss of equipment or fishing accessories.

c)  BBH reserves the right to use the security deposit to pay for any and all loss or damage sustained by the vessel while being hired by the Hirer.


3. CANCELLATIONS

a) Cancellation of hire will incur the loss of Hirer’s total booking fee if the Hirer cancels their booking within 48 hours of the hire date.


4. INSURANCE

a)  A fee of five hundred dollars ($500.00) is payable to BBH for any misuse or damage to the vessel and equipment.

b)  No property of the Hirer nor that of any passenger on the vessel is insured at any time by BBH. BBH will not be liable for any loss or damage to property of the Hirer or any passenger of the vessel.

c)  Hirers are liable for any misuse and mistreatment of vessel, and will be liable to pay the insurance excess to cover cost of all damages.


5. DAMAGE/LOSS

a)  Any required cleaning of vessel, trailer and equipment will incur a minimum fee of $500, and any substantial cleaning will incur an additional fee of $100 an hour; such fee will be deducted from the Hirer’s security deposit.

b)  Any and all damage or loss to the vessel, trailer and equipment is the responsibility of the Hirer.

c)  Any and all damage will incur a fee, which will be deducted from the Hirer’s security deposit. BBH reserves the right to obtain a quote for any and all damages, which is payable by the Hirer in full.

d)  A minimum repair fee of $50.00 is payable for scratches and dents.

e)  Any damage or loss of fishing equipment or tackle will incur a replacement fee payable by the Hirer, and will be deducted from the Hirer’s security deposit.

f)  BBH will not be held liable for any injuries or damages including, but not limited to, the Hirer, any passenger of the vessel, or any person or thing which the Hirer, a passenger, or the vessel comes into contact with.

g)  In the event the boat is returned without a full tank of unleaded fuel, the Hirer will incur the cost of $3.00 per litre for every litre required to be purchased by BBH to achieve a full tank, with deductions to be made from the security deposit.


6. NORTHERN TERRITORY LAWS/FISHING PERMITS

a)  This agreement is governed by the laws of the Northern Territory and the Commonwealth of Australia, as applicable.

b)  The Hirer is responsible for obtaining any necessary permits including, but not limited to, any permits for access to Aboriginal land and waters issued by the Northern Land Council.

c)  If any term in this Agreement is void or otherwise unenforceable then that term will be severed and the remainder of the terms shall continue in force.


7. LIABILITY/INDEMNITY

a)  BBH, its officers, employees and agents will not be held liable in any circumstances for any loss or damage which arises out of the use or attempted use of any BBH vessels, trailers, contents and equipment.

b)  The Hirer will at all times indemnify BBH and keep it and its officers, employees and agents indemnified from and against any loss (including direct and consequential loss), damage or liability incurred by it arising from any claim, demand, suit, action or proceeding by any person, arising out of, in connection with or in respect of.

i. any breach of these terms by the Hirer or its passengers; and/or

ii. the Hirer or its passenger’s use of the vessel, its trailer and associated contents and equipment.
